GENERAL TERMS AND CONDITIONS
The following terms and conditions apply to orders, delivery, and collection of orders via the webshop (the “Webshop”) via tikawine.com (the “Website”).
These general terms and conditions also apply to customers acting in the course of a profession or business. The applicability of the buyer's general terms and conditions is expressly rejected.
By placing an order you agree to these Terms and Conditions.
PRIVACY & SECURITY
Placing orders in the Webshop is only possible if you create an account on the Website. In order to create your account and deliver the functionalities, we process certain personal data from you, including your email address, your password, and your date of birth. This allows you to continue to use your account and we ensure that you can log in securely. You can view all the data you have provided online with us in one place under “My account” on the Website. This information is personal and we ask you to treat it confidentially, in particular by using your email address and password only for your own use and only storing it on your own computer. We will do our best to ensure that the Website is virus-free as much as possible, but unfortunately, we cannot guarantee this. The Website contains links to third-party websites. We select the websites referred to as carefully as possible. However, we cannot guarantee the content and functioning of third-party websites.
INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights with regard to the Website, including those with regard to the software, texts, images and sounds, rest with tikawine.com and/or those from whom we have obtained a license. This means, among other things, that it is not permitted without our permission to publish, reproduce and / or edit the information stated on the Website, except for personal use.
When you visit the Website you must first enter your age (the so-called age check) before you are allowed on the Website. If you place an order with us via the Webshop, you must first create an account with an email address, date of birth, and password, with which you can now easily log in. When the order is delivered, the delivery person will ask for identification if there is any doubt about the age of the person to whom the order is issued. The age check applies to at least up to 21 years. Valid identification documents include a national passport and a European identity card. If the minimum age requirement is not met, our delivery person is unfortunately forced to take back the order or not to hand it over. If the order cannot be delivered because it has not been established that the age requirement has been met, cancellation costs of EUR 10.00 will be charged. The reason is that we want to discourage minors from trying to place orders anyway. See also “Delivery of your order”.
DIGITAL MARKETING AND SOCIAL MEDIA
The content of Facebook, Instagram and emailing is only intended for persons aged 21 years and older. By liking the Facebook account, following the Instagram account, or subscribing to the mailing you confirm to be 21 years or older. Nothing may be forwarded to or otherwise made available to persons under the age of 21.
DELIVERY OF YOUR ORDER
If you place an order in the tikawine.com Webshop, DPD (Deutsche Post) will take care of the delivery of the items to the delivery address in the Netherlands or other EU member state countries.
Delivery via Bottle Package:
If you order before 14:00 on a working day, the carrier usually selected by DPD will deliver the order on a day after to the delivery address in the Netherlands. We strive to meet these delivery times and times, but unfortunately, we cannot guarantee the delivery times. You cannot, therefore, hold us to account for late delivery.
We request that you be present at the agreed delivery time to receive the order. The DPD deliverers will ask for identification when in doubt about the required age. If the minimum age requirement of 21 years is not met, our delivery person is unfortunately forced to take the order back. The order will be canceled and a cancellation fee of EUR 10.00 will be charged.
The deliverers will ask you to sign for receipt of the order.
If you are not present at the agreed delivery time, the deliverers will try to deliver the order to the neighbors. The order will only be delivered to the neighbors if the receiving person is 21 years or older. If delivery to neighbors is also not possible, DPD will leave a message in the letterbox of the addressee and offer the order again the next day (except Sunday and Monday). If the second delivery attempt (via identical procedure) is unsuccessful, the order will be returned to us. The customer will be reimbursed the order amount minus the shipping costs and any transaction costs.
It is also possible to pick up your order at PostNL pickup locations. However, this depends on the date and time to be coordinated. When this has been agreed, the order can be paid by means of a discount coupon, so that no delivery costs will be charged.
In principle, it is not possible to cancel an order (via the Webshop) after the order has been confirmed by us (a receipt of order confirmation by email). Depending on the day and time, cancellation may still be possible by contacting Customer Service (+31627468794)
PAYMENT OF YOUR ORDER
You can pay for the online order via iDeal (direct payment via internet banking), Paypal or Credit Card. You will receive the invoice of your order via email. For more information about payments, please refer to the relevant payment platform provider.
If you do not want to have certain products within 5 days after receipt of the order, you can return them to us. For this you need to contact our Customer Service (+31627468794) who will explain the return process and applicable conditions to you. Returns are only accepted if the original packaging and contents including the product label are undamaged. The costs for returns are for your account.
The orders received must be immediately checked for visible defects. In case of identified (visible and invisible) defects, you must contact our Customer Service (+31627468794) after these defects have been discovered, who will further explain the return process and the applicable conditions. Return the defective products for which we will bear the costs. We request that you include a printout of the email in which our Customer Service confirms the return shipment with the return package so that everything can be processed correctly by us. We recommend that you keep the shipping receipt for your own records. In case of breakage or incorrectly delivered items, you can choose to have the amount of the item in question credited or the product sent to you. In case of breakage, we only do this if the breakage has been reported no later than the next working day following the day on which it was delivered. We, therefore, expect you to check the delivered package for breakage immediately upon receipt. It is only possible to send it back to Customer Service if the product is in stock. Adjustment of the amount to be paid or return of the amount already paid is as follows:
Within a week after receipt of your return, the money will be refunded to your account. If an item is not returnable due to, for example, breakage, tikawine.com will refund the relevant return amount to your account within a week after reporting the defect to Customer Service.
Our products are intended for end users and you are not supposed to resell them. We therefore reserve the right not to deliver orders when in doubt or to limit the quantities of certain items to be ordered. Although the Website has been created with the greatest care, it is possible that the characteristics of products (price, appearance, allergen listing, product information, supplier information, alcohol percentage, volume) may not be correctly displayed or depicted. In that case, the characteristics shown on the packaging of the product itself apply and you cannot claim delivery on the basis of incorrectly displayed information.

We can change these Terms and Conditions. The changed conditions will take effect as soon as you place a new order with us. You thereby indicate that you agree with the changed conditions.
